Vestahire Website Terms and Conditions

The Deveny Group trading as Vestahire
ABN 18 160 910 396  |  Last updated 21 September 2026

These terms explain how you may use vestahire.com.au and the online forms, booking pages and event tools we make available through it. “Vestahire”, “we”, “us” and “our” mean The Deveny Group trading as Vestahire. “You” means the person using the website.

Please read these terms before using the website. By using it, you agree to these terms to the extent they apply to your use. Nothing here excludes rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law.

1  Website use and bookings

Browsing the website does not create a hire booking. Equipment hire and related services are governed by our Terms and Conditions of Hire and your accepted quote and booking documents. If these website terms conflict with your agreed hire terms about the booking, the hire terms apply to that matter.

Every quote and booking confirmation we issue must include a direct link to the Terms and Conditions of Hire and identify the applicable version. You must have an opportunity to read and accept the hire terms before confirming a booking. Later changes to the website do not replace the terms agreed for an existing booking.

An enquiry, availability indication or acknowledgement of receipt is not a confirmed booking. Confirmation follows the acceptance, payment and availability requirements in the hire terms and your booking documents. You must be at least 18 and have authority to make a hire booking, including when acting for an organisation.

2  Information prices and availability

We take reasonable care with website information. Examples, photographs and package descriptions help explain our services; the equipment and inclusions for your event are specified in your accepted quote. Tell us before booking about any particular requirement you need us to meet.

Prices are in Australian dollars and include GST. Any applicable delivery, collection or additional service charges will be disclosed before you commit to a booking. Prices and availability for new enquiries may change. We will correct errors promptly, but an error does not give us an unrestricted right to alter or cancel an existing agreement.

3  Competitions and promotions

Each competition or promotion has its own published terms covering matters such as eligibility, entry requirements, closing dates and prizes. Those terms apply to participation and take priority over these website terms for that competition or promotion. Entry does not itself create a hire booking or guarantee equipment availability for another date.

4  Permitted website use

You may browse the website, make genuine enquiries, use authorised event tools and download material made available for those purposes. Use the website lawfully and respect other people’s rights and privacy.

You must not use the website to impersonate another person, submit fraudulent bookings or false payment details, send spam, distribute malicious software, harass others or upload unlawful material. Do not bypass access controls, interfere with security or attempt to access another customer’s booking, files or event controls.

Do not use automated tools to overload the website, defeat submission limits or collect personal information without authority. Do not copy or commercially exploit protected website material beyond the permission in clause 6 or what the law allows. Ordinary use of accessibility tools and lawful search-engine indexing are not prohibited by this clause.

5  Forms private links and event access

Provide accurate information to the best of your knowledge and correct material errors promptly. Only provide another person’s contact details or material where you have appropriate authority. Check the event, recipient and information before submitting or approving content.

Keep passwords, moderator credentials, private booking links and customer download links secure. Share them only with people authorised to perform the relevant role. Public guest-submission links and QR codes may be shared with intended participants in accordance with the event organiser’s instructions.

Tell us promptly if you suspect unauthorised access or a security problem. We will assess the circumstances; you are not automatically liable for every action taken using a link or credential. Keep copies of important material you supply. This does not remove our responsibility for any storage or delivery service we have agreed to provide.

6  Website content and intellectual property

Copyright and other rights in website text, photographs, videos, designs, graphics and software belong to Vestahire or the relevant rights holders. References to Vestaboard and other third-party names do not transfer ownership of their trade marks or material.

You may view the website and save or print reasonable extracts for your own event planning, internal business evaluation or management of a booking. Keep copyright notices and attribution intact. You may share links to public pages provided you do not misrepresent an association with, or endorsement by, Vestahire.

You need the relevant rights holder’s permission to republish, sell, distribute or adapt protected material beyond these permitted uses, unless the law allows the use. These terms do not restrict statutory copyright exceptions. Contact us if you would like permission to use our material or believe something on the website infringes your rights.

7  Material you submit

You retain your rights in content you submit. You give us a non-exclusive permission to store, reproduce, format and transmit that content only as reasonably needed to respond to your enquiry, administer your booking or entry, operate the service you use and meet legal obligations. Relevant service providers may process it for those purposes.

For event messages, this permission includes displaying the message and any submitted display name at the intended event and including them in an event record or export where that feature is disclosed to participants. A private enquiry, venue plan or booking upload is not permission to publish it publicly.

You must have the rights and permissions needed for the material you supply. Do not submit unlawful, defamatory, threatening, discriminatory or harassing content, infringe another person’s rights, or reveal private information without appropriate permission. Keep sensitive personal information out of public messages.

Submitting content does not give us blanket permission to use it, your identity, your event photographs or your branding in advertising. Any marketing use requires separate permission where needed. We will handle retention and deletion in accordance with our Privacy Policy and applicable obligations.

8  Guest messages and online event tools

Where available for an event, guest messaging and customer tools operate within the features, access periods and settings selected for that booking. Use the correct event link and follow the instructions shown. Submitting a guest message does not make you the hirer or authorise you to change the booking.

A message and any display name you submit may be visible to event attendees and to the organiser or moderator. The organiser’s selected moderation settings determine whether messages need human approval. A profanity filter is a separate setting and may miss inappropriate words or context. Submission or approval does not guarantee display; timing can depend on the queue, connection and event window.

We or an authorised event moderator may decline or remove a message or restrict access where reasonably necessary to address unlawful content, a breach of the event rules, security concerns or misuse. We will keep our response proportionate. Any obligations we have agreed to provide as part of a paid hire remain governed by the hire agreement and applicable law.

9  Privacy cookies and communications

Our Privacy Policy explains how we collect, use, disclose and protect personal information, and how to contact us about it. Read it together with the collection notices shown on enquiry forms, booking pages, competition entries and guest-message pages.

The website may use cookies and similar technologies for functions such as security, form handling and measuring site use. Details and any available choices are explained in the Privacy Policy or relevant website notice. Browser settings can restrict cookies, although some functions may then be unavailable. These terms do not treat continued browsing as consent to every use of personal information.

We may send communications needed to respond to your enquiry or administer a booking or entry. Marketing subscriptions and any associated conditions will be explained when you sign up. You can unsubscribe from marketing using the instructions in those messages; this does not prevent necessary service communications.

10  Website availability and changes

We take reasonable steps to operate the website reliably and securely. Maintenance, faults and external events may interrupt access, and features may not work on every device. We remain responsible for exercising reasonable care and meeting our agreed obligations.

We may update features, content and security measures. Changes affecting a booked service must be dealt with under the hire agreement and applicable law; they do not automatically reduce your entitlements. If you cannot use a form or booking tool, contact us by email.

11  External websites and services

External websites, payment services and communication services may have their own terms and privacy notices. A link does not necessarily mean we endorse an external website. We do not control independent websites, but remain responsible for our own representations and agreed services, including services delivered with a provider’s help.

12  Responsibility and your rights

Nothing in these terms excludes or limits a consumer guarantee, right, remedy or liability that cannot lawfully be excluded or limited. Where the law entitles you to a remedy, that entitlement applies despite any other wording in these terms.

Each party is responsible for loss to the extent caused by its breach of an applicable obligation or negligence. Responsibility must reflect each party’s contribution and reasonable steps taken to avoid further loss. You do not give us a blanket indemnity for use of the website or release us from liability for our own conduct.

13  Restricting access

We may restrict access where reasonably necessary to address a security threat, unlawful activity or a serious or repeated breach of these terms. Where practicable, we will explain the reason and give you an opportunity to resolve it. Urgent action may be taken first where needed to protect people, information or systems.

Restrictions will be proportionate to the issue. If your access is restricted during an existing booking, we will provide a reasonable alternative contact route. Restricting website access does not automatically cancel a hire booking or forfeit a payment. Contact us if you believe a restriction is mistaken.

14  Updates governing law and contact

We may revise these terms by publishing an updated version and changing the date above. Changes apply prospectively. We will give reasonable notice of material changes affecting ongoing website use where practicable, and obtain fresh acceptance where required. Revised terms do not retrospectively change an accepted hire booking, competition entry or accrued right.

Victorian law and applicable Australian law govern these terms. A dispute may be brought before a court or tribunal with lawful jurisdiction; no statutory right to use another forum is removed. If a provision cannot be enforced, the remainder continues to the extent it can operate fairly and lawfully.

For website questions, access problems, content complaints or concerns about these terms, contact The Deveny Group trading as Vestahire at admin@vestahire.com.au. We will consider the information you provide and seek to resolve the issue. You may also seek assistance from the relevant regulator or use an available legal remedy.
